Risk Management

Risk management is extremely important for psychologists. This is because it establishes a code of conduct which can be effectively used by the psychologist to avoid unnecessary ethical dilemmas and situations that can lead to a lawsuit.

The first risk management is always to keep communication channels open. It is critical to understand that those that are often involved in a dialogue that is reasonable are in most instances not likely to sue each other. In fact, research has shown that indeed good communication is often associated with reduced professional liability claim (Leitch, 2008). The second risk management strategy is to write down every decision in writing. The old documentation rule states that if it was not written, then it was not done. This, therefore, highlights the importance of documenting. There are instances where one’s notes are the only evidence that can be used when a situation goes wrong. In fact, adequate record keeping often provides the first indication to the attorneys that a practitioner has been able to meet the minimum standards of care effectively.

There is a need to maintain clear boundaries with clients. Having sex with a client is often referred to as the most egregious unethical behavior (Woody, 2012). Research has shown that sexual impropriety often accounts for approximately half of the costs of the malpractice cases and over 20% of the number of total claims. There is a need to ensure that one makes clear to the client the boundaries and creates professional boundaries him or herself (Conroy & Murrie, 2007).

The risk management strategies are extremely important for forensic psychology that in most instances is in the position of power over the client. Therefore, they help in ensuring that one does not find him or herself in unnecessary lawsuits.
